Terms of Service

Rules of the road.

These Terms of Service ("Terms") govern your access to and use of the applications, websites, and services (collectively, the "Services") provided by Folding Sky Co. ("Folding Sky," "we," "us," or "our"). Our current apps include Alarmist (LiDAR-powered motion detection), Busybody (website screenshot widgets), Cumbersome (direct API access to AI providers), Dense (widget-first news digests), and Endemic (on-device local LLM chat). These Terms also apply to future Folding Sky products that link to them, unless that product provides different terms.

Acceptance of Terms

By accessing or using our Services, you agree to be legally bound by these Terms and all policies and guidelines referenced here, including our Privacy Policy (folding-sky.com/privacy). If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. If you do not agree to these Terms, you may not use the Services.

Eligibility and Age Restrictions

Cumbersome and Endemic are intended for users who are at least 18 years old. By using Cumbersome or Endemic, you represent and warrant that you are at least 18 years of age.

All other Folding Sky apps (Alarmist, Busybody, Dense) are intended for adult audiences. While they do not impose a specific minimum age beyond what is required by applicable law and the Apple App Store, they are not designed for, marketed to, or intended for use by minors. If you are under 18 (or the age of majority in your jurisdiction), you should use our Services only with the involvement and consent of a parent or legal guardian.

We do not knowingly collect personal information from children. See our Privacy Policy (folding-sky.com/privacy) for details.

Definitions

  • Services: Our websites, applications, and related features we provide.
  • User Content: Prompts, settings, and other materials you submit or configure.
  • AI Content: Output generated by third-party AI providers or local models.
  • Providers: Third parties (for example, OpenAI, Anthropic, Google AI Studio) that process your data.

App-Specific Terms

Each of our apps has different capabilities, architectures, and terms. This section covers what you need to know for each app.

Alarmist

Architecture: Alarmist operates with no Folding Sky backend. All LiDAR motion detection processing happens entirely on your device. We do not create or manage user accounts.

Permissions: Requires camera/LiDAR access for motion detection. You control whether captured photos are saved to your Photos library.

iCloud Sync: Alarmist can sync detection history (event timestamps, detection metrics, and captured photos) across your devices via CloudKit using your personal iCloud account. This sync is enabled by default and can be disabled in the app's settings. iCloud sync is subject to Apple's iCloud Terms of Service. Folding Sky does not have access to data stored in your iCloud account. You are responsible for managing your iCloud storage and settings.

Third-Party Services: All LiDAR motion detection processing uses native iOS capabilities. Alarmist does not use AI services.

Ad Conversion Tracking: Alarmist integrates third-party SDKs from Google and TikTok to measure advertising campaign effectiveness. By using Alarmist, you acknowledge that device identifiers and purchase events may be shared with these providers for ad attribution. You can decline the App Tracking Transparency prompt to prevent access to your device's advertising identifier. See our Privacy Policy (folding-sky.com/privacy) for full details on what data is collected and shared.

Silent Detection Mode: Alarmist includes an optional silent detection mode that suppresses the audible alarm and flashlight while continuing to detect motion, capture photos, and log detection events. Since there is no flash, this mode is primarily useful in lighted or dim conditions. This feature is designed for use in spaces where you have a reasonable expectation of control, such as your own home, hotel room, or personal property. Alarmist does not currently record audio or video, but future versions may add recording capabilities with appropriate notice and consent mechanisms.

Your Legal Responsibility Regarding Privacy and Surveillance Laws: Many jurisdictions have laws governing surveillance, monitoring, and recording, including but not limited to wiretapping statutes, eavesdropping laws, hidden camera prohibitions, and workplace monitoring regulations. These laws vary significantly by jurisdiction and may apply even when no audio or video is recorded. Some jurisdictions require all-party consent for any form of monitoring in spaces where individuals have a reasonable expectation of privacy.

By using Alarmist (including silent detection mode), you represent and warrant that:

  • You have the legal right to monitor the space where you deploy Alarmist
  • Your use complies with all applicable federal, state, local, and international laws regarding surveillance, monitoring, privacy, and recording
  • You will not use Alarmist to monitor individuals without proper legal authority or required consent
  • You will not deploy Alarmist in any location where monitoring is prohibited by law
  • You understand that silent or covert detection may carry additional legal obligations in your jurisdiction

Folding Sky does not provide legal advice. If you are uncertain whether your intended use of Alarmist complies with applicable law, consult a qualified attorney in your jurisdiction before use. Folding Sky is not responsible for any illegal or unauthorized use of Alarmist.

Not a Security System: Alarmist is a convenience tool, not a security device. It cannot guarantee detection of all motion, prevent intrusion, or protect you from harm. Technology can fail. LiDAR sensors have limitations. Environmental conditions affect detection reliability. This app is provided as-is for informational awareness only.

No Guarantee of Protection: Alarmist should never be your sole means of protection. Do not rely on it for personal safety or as a substitute for proper security measures. Test thoroughly in your specific environment and understand its limitations before use.

Busybody

Architecture: Busybody operates with no Folding Sky backend. Website screenshots are captured and stored locally on your device. We do not create or manage user accounts.

Permissions: No special device permissions required. Screenshots are captured using a standard embedded web browser.

Third-Party Services: Busybody does not use any AI services. However, it accesses third-party websites that you specify.

Website Access: Busybody captures screenshots from websites you specify using an embedded web browser. A website may treat these captures as automated access. The Website Access and Automated Actions section below applies to your use of Busybody.

Cumbersome and Endemic

Cumbersome and Endemic are Folding Sky's AI-powered apps. They share underlying technology but serve different purposes and connect to AI in different ways. Neither app has a Folding Sky backend for AI processing. We do not create or manage user accounts for either app. See the Artificial Intelligence Disclosure section below for important information about AI-generated content.

Cumbersome (Cloud AI Client): Cumbersome acts as a client application that facilitates direct communication between your device and third-party AI providers (such as OpenAI, Anthropic, Google AI Studio, OpenRouter, Z.ai, Vercel AI Gateway, and others we may add). You must provide your own API keys or other authentication values. By using Cumbersome, you acknowledge and explicitly consent to the transmission of the content you enter (including prompts, messages, conversation context, and any attached images or files) to third-party AI providers for processing. Folding Sky does not collect, store, or have access to the content you send to AI providers. You are responsible for securing every credential you configure.

App-Authored Instructions and Tools (Cumbersome only): To provide Cumbersome's current and future features, the app may include app-authored prompts, system instructions, tool or function definitions, attachment framing, and related request data in communications with the AI provider you select. Examples include instructions used to generate conversation titles, compare responses, draft a Ghost/Write message, compact conversation history, ask structured clarification questions, or let a model use enabled tools. These additions may affect model behavior, token usage, and provider charges. We use them only to perform the app's stated functionality and keep them as focused as practical. Some are part of default features, while others apply only when you enable or explicitly invoke a feature. See Cumbersome Data, API Keys, and Prompt Transparency (folding-sky.com/cumbersome/transparency) for more information and examples. That page is explanatory and may not contain a complete or current inventory of every feature or request.

Camera Attachments (Cumbersome only): If you capture a photo inside Cumbersome, you are responsible for having the right to capture and share it. The photo becomes User Content and is sent to the selected AI provider if you send the message containing it. Do not capture or submit images in violation of another person's privacy, intellectual property, or other rights.

Question Cards (Cumbersome only): The selected model can call this tool to ask structured questions before answering. Cumbersome returns your answers, or your decision to skip, to the provider as the tool result. The result may be stored with the conversation. The questions and suggested choices are AI Content, so review them before responding. Tool instructions say not to request secrets or use the cards to confirm an external action, but instructions cannot guarantee appropriate behavior. Do not enter credentials or other secrets into a Question Card, and do not treat a card as authorization for a separate action.

Browser Tools (Cumbersome and Endemic): Cumbersome and Endemic provide Local Web Search, which sends an AI-generated query to a search engine and returns result links and snippets; Local Web Browser, which loads one page, can run AI-generated JavaScript once, extracts readable content, and then discards that page; and Web Agent, a visible browser that keeps page and navigation state for multi-step work and can operate on sites you sign into. Availability, settings, and initial defaults vary by operating system and app version and can change over time. When a browser tool is used, the selected model may propose searches, navigation, page inspection, JavaScript, form interaction, and other browser steps for the app to execute from your device. Cumbersome may return browser tool results to the AI provider you selected. Endemic processes browser tool results with the local model running on your device, but search engines and websites still receive requests directly from your device. A webpage can contain text or code that influences the model's later actions, including content designed to mislead an AI system. In unusual or unintended cases, an AI-generated browser action could include information from your prompt, conversation, or a page in a request to a third-party website or service. The apps instruct models not to inspect password, payment, passkey, or authentication fields, but instructions and model safeguards cannot guarantee that sensitive information will never be accessed or transmitted. The visible browser lets you observe and intervene, but it does not eliminate this risk. You are responsible for supervising browser activity and deciding which sites and accounts to use. The Website Access and Automated Actions section below applies whenever you use these tools. Avoid AI-assisted browsing with highly sensitive accounts or information unless you accept these risks.

Remote MCP Servers (Cumbersome and Endemic): Both apps may let you configure remote Model Context Protocol (MCP) servers or similar tool services. When you enable and invoke a remote tool, the app sends tool requests and arguments directly to the server you configured. Those arguments may include information from your prompt, conversation, attachments, or model-generated content when needed for the requested tool. Server results may be added to your conversation and, in Cumbersome, returned to your selected AI provider as tool results. You are responsible for choosing and securing each server, understanding its terms and privacy practices, and reviewing what you send. Folding Sky does not operate or control a user-configured server unless we specifically identify it as a Folding Sky service.

Endemic (On-Device Local LLM): Endemic runs large language model inference on your device using downloaded model weights (GGUF format). Network access is required to download models from the catalog; inference does not require network access after models are downloaded. Model weights are downloaded from third-party publishers and hosts. You are responsible for complying with any license or terms that apply to those model files. Folding Sky does not host model files and does not control third-party hosts.

Provider Relationship: For Cumbersome, AI processing and outputs are provided by the third-party AI provider you select and are governed by that provider's terms and policies. Cumbersome functions as a client interface that sends your requests using your API key. For Endemic, AI output is produced by local models on your device using weights from third-party publishers. In both cases, Folding Sky does not provide, train, host, or control the underlying AI model.

Provider Access Restrictions (Cumbersome only): You may use a provider through Cumbersome only if that provider permits access from your current country or territory. Your provider account must also be authorized for that access. Cumbersome's technical ability to connect does not grant permission to use the provider. You must not use Cumbersome with a VPN, proxy, location spoofing, or any other method to evade a provider's geographic, account, sanctions, export-control, or other access restrictions.

AI Content: AI Content generated through Cumbersome or Endemic is not created by Folding Sky. See the Artificial Intelligence Disclosure and Disclaimer of Warranties sections for important limitations on AI Content.

API Cost Monitoring (Cumbersome only): Cumbersome may provide estimates of API usage costs from third-party providers. These estimates are provided for informational purposes only and are not guaranteed to be accurate. Actual costs may vary based on provider pricing changes, token counting methodologies, model updates, or other factors. You are solely responsible for monitoring your actual API usage and costs directly with each provider.

Product Analytics: Both apps send limited technical and product-usage data to Firebase Analytics, including pseudonymous identifiers. By using these apps, you acknowledge this data collection. See our Privacy Policy (folding-sky.com/privacy) for details on what is collected and how it is used.

iCloud Sync: Both apps automatically sync data via your personal iCloud account when iCloud is enabled on your device. Each app uses a separate iCloud container. This sync is subject to Apple's iCloud Terms of Service. You are responsible for managing your iCloud storage and settings. Folding Sky does not have access to data stored in your iCloud account.

Dense

Architecture: Dense uses a Folding Sky backend to query Gemini with search grounding and generate news digests. We do not create or manage user accounts.

Permissions: Requires network access for digest updates.

AI-Generated Digests: Dense displays a rolling micro digest per topic, generated by Gemini with search grounding. Folding Sky operates backend services to process these queries.

AI Content Disclaimer: Digests and summaries in Dense are generated by Google's Gemini AI. We do not guarantee the accuracy, completeness, or timeliness of this content. AI-generated content may contain errors, omissions, or reflect biases in the underlying data. Dense is designed for quick scanning and is not a primary source. Always verify important information from primary sources.

User Accounts

None of our current apps (Alarmist, Busybody, Cumbersome, Dense, Endemic) require user accounts. App content and settings are stored locally or, where described above, in your personal iCloud account. This does not include data transmitted to AI providers, third-party websites, analytics services, or Dense's backend as part of the functions and data practices described above.

If we introduce account-based features in the future, you will be responsible for safeguarding your account credentials and for all activities that occur under your account.

Device Responsibilities

You are responsible for any devices that store your credentials or app data. Activity from such devices is deemed authorized by you.

Communications

We may send service notices, legal notices, and administrative messages by any reasonable means, including in-app notices, click-through prompts, website postings, or email if you have provided an email address. You agree that these electronic communications satisfy any legal communication requirements to the extent permitted by law.

For material updates, we may use one or more supplemental notice methods designed to draw attention to the change, such as an in-app interstitial, a required acknowledgment screen, an email notice, or a prominent website notice. You can opt out of marketing emails using provided unsubscribe controls. Some mobile features may incur carrier data charges, which you are responsible for.

Payments, Subscriptions, and Refunds

Fees

Some Services offer one-time in-app purchases or subscriptions through the Apple App Store. We may introduce fees for a Service or feature that was previously available at no charge, change prices, or move features between free and paid tiers. The applicable storefront will show the price and purchase terms before you authorize a charge.

Subscriptions

App Store subscriptions automatically renew at the end of each subscription period until you cancel them through your App Store subscription settings. Cancellation takes effect at the end of the current paid period unless Apple states otherwise. Deleting an app does not cancel its subscription.

Payment Processing and Refunds

Apple processes current in-app purchases, billing, cancellations, and refund requests under its own terms. Folding Sky does not receive your full payment-card details. Our apps receive StoreKit transaction and entitlement information needed to provide or restore purchased access. If we introduce another payment method, we will identify the processor and applicable terms before purchase. Refunds are subject to the applicable storefront's rules and any rights that cannot be waived under law.

Taxes

Taxes are handled as disclosed by the applicable storefront or payment processor. You remain responsible for taxes that law requires you to pay directly.

License and Intellectual Property

The Apps and their original content, features, and functionality are owned by Folding Sky Co. and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Apps for personal purposes. AI-generated content is subject to the intellectual property terms of the respective AI providers.

Your Content. You retain ownership of any intellectual property rights in the content you submit to the Services (e.g., text prompts, settings). To the extent your content is transmitted to or processed by Folding Sky systems for a given Service, you grant Folding Sky a worldwide, royalty-free license to use, host, and store that content for the limited purpose of operating, improving, and providing the Services. For Services designed without a Folding Sky backend (including Cumbersome), we do not receive your prompts or AI responses, and this license applies only to information you provide directly to us (for example, support messages or feedback).

Feedback. If you provide us with feedback, ideas, or suggestions, you grant us the right to use it without any restriction or compensation to you.

Third-Party Services and Content

General Disclaimer. Some of our Apps integrate with or facilitate access to third-party services, content, or platforms. We do not guarantee the accuracy, completeness, reliability, or safety of third-party content or services. You use such content and services at your own risk.

Third-Party Terms. Your use of third-party services is subject to their own terms of service and privacy policies. You are responsible for complying with those terms and for any costs associated with your use of their services.

AI Evaluations and Rankings. Any AI-generated evaluation, ranking, comparison, recommendation, or "best answer" style output shown in any Service is informational only and must not be treated as professional, legal, medical, financial, tax, accounting, or psychological advice.

Artificial Intelligence Disclosure

AI Outputs Are Machine-Generated

All AI-generated content obtained through any Folding Sky Service is produced entirely by artificial intelligence systems. You are not communicating with a human when you interact with AI features in our apps. AI outputs are statistical predictions based on training data and do not reflect the opinions, judgment, or expertise of Folding Sky or any individual.

Folding Sky Is Not an AI Provider

Folding Sky develops apps and supporting services. We do not train or control the underlying AI models used by the Services.

  • Cumbersome is a client application. It transmits your prompts to third-party AI providers (such as OpenAI, Anthropic, Google AI Studio, and others) using API keys that you provide. Folding Sky never receives, processes, or stores your prompts or AI responses. The AI provider you select is solely responsible for the model's behavior and output.

  • Endemic is a local runtime environment. It runs open-weight large language models (GGUF format) downloaded from third-party publishers directly on your device. Folding Sky does not host model files, does not perform inference, and does not control model behavior. The model publisher is responsible for the model's training data and capabilities.

  • Dense displays news digests generated by third-party AI (Google Gemini) on Folding Sky's backend. Folding Sky operates the backend service but does not train or control the underlying AI model. Digests are informational summaries, not primary reporting.

Provider Changes and Separate Agreements

Third-party AI providers control their models, APIs, pricing, usage limits, default settings, safety systems, data practices, and other behavior. They may add, remove, or change any of these at any time, including without notice to Folding Sky or to you where their terms permit. A provider change may affect a Service's availability, cost, output, or behavior even when Folding Sky has not changed the app.

Your account, API key, and use of a third-party AI provider are governed by your separate agreement with that provider, including its terms of service, acceptable use policies, privacy policy, and billing terms. Folding Sky is not a party to that agreement and cannot control or guarantee a provider's continued availability, compatibility, pricing, defaults, or behavior. You are responsible for reviewing and complying with the provider's current terms and monitoring changes to your provider account and usage.

No Professional Advice

AI-generated content obtained through any Folding Sky Service must not be treated as professional advice. This includes, without limitation, legal, medical, psychological, financial, tax, accounting, engineering, or any other advice that would ordinarily require a licensed or credentialed professional. Do not rely on AI output as a substitute for consultation with a qualified professional. If you need professional advice, consult an appropriately licensed practitioner in your jurisdiction.

Accuracy and Reliability

AI models can produce output that is incorrect, incomplete, misleading, biased, or inappropriate. AI output may appear confident or authoritative while being factually wrong. Folding Sky does not verify, endorse, or guarantee the accuracy of any AI-generated content. You are solely responsible for evaluating and verifying AI output before relying on it.

Evolving Legal Requirements

Laws and regulations governing artificial intelligence are developing rapidly across jurisdictions. You are responsible for understanding and complying with any AI-related legal requirements that apply to your use of AI-generated content, including disclosure obligations, restrictions on automated decision-making, and sector-specific regulations. Folding Sky may update these Terms to reflect new legal requirements as they take effect.

User Conduct and Responsibilities

You are responsible for your conduct while using the Services. You agree to comply with all applicable laws and regulations in connection with your use of the Services. Where applicable, you are responsible for securing any credentials, API keys, or access tokens, and will not hold us liable for any misuse of such credentials.

If we implement location-based or jurisdiction-based compliance features, you agree to provide truthful and accurate location information when prompted and not to misrepresent your location or jurisdiction through VPNs, location spoofing, or other means for the purpose of circumventing applicable restrictions.

Website Access and Automated Actions

Some Services can access, search, capture, extract from, or interact with third-party websites from your device. This includes Busybody's screenshot captures and the browser tools in Cumbersome and Endemic. These features may act automatically, including by executing steps proposed by an AI model. A website may treat page loads, screenshots, content extraction, JavaScript, form interaction, or repeated requests as automated access.

You may use these features only with websites, accounts, and content that you are authorized to access, and only in compliance with applicable law, the website's terms and acceptable use policies, robots.txt directives, and other published access instructions. A Service's technical ability to reach a site or perform an action does not give you permission to do so. You are responsible for reviewing browser actions and obtaining any permission needed to access, capture, extract, copy, submit, publish, or otherwise use third-party content or data.

When using the Services to access a third-party website, you must not:

  • Circumvent paywalls, login requirements, rate limits, robots.txt directives, or other technical or contractual access controls
  • Use AI or automation to solve, bypass, or evade a CAPTCHA or other anti-bot challenge. If you are authorized to use the site, you may complete its ordinary verification challenge yourself.
  • Access a website, account, computer system, or data without authorization
  • Make excessive, rapid, or deceptive requests, or scrape or extract content in a way that disrupts a service or places an unreasonable load on its infrastructure
  • Capture, reproduce, publish, distribute, or use content or personal data without the rights or permission required to do so

Folding Sky does not monitor, review, or approve the websites you access or the actions you direct through the Services. You assume responsibility for determining whether each use is lawful and permitted. Folding Sky is not liable for claims, damages, or legal actions arising from your access to or use of third-party websites.

Cybersecurity and Harmful Automation

Cumbersome and Endemic can generate code and use browser, data, and remote tools. These capabilities can take actions with real effects. You must not use any Service, AI Content, tool, or connected server to carry out, facilitate, conceal, or materially assist malicious, deceptive, abusive, or unauthorized cyber activity.

You may conduct security testing only on systems you own or when a person or entity authorized to grant permission has given you prior express authorization. A published vulnerability disclosure or bug bounty policy counts as authorization only for the targets, methods, time periods, and other conditions that it expressly places in scope. Permission to use an account, access public content, or operate a website normally does not by itself authorize security testing. You must stay within the authorized scope, avoid harm, minimize access to data, follow applicable reporting and disclosure rules, and stop if authorization is unclear, exceeded, or revoked.

You must not use the Services to:

  • Scan, probe, enumerate, or test systems for vulnerabilities without express authorization
  • Exploit a vulnerability, escalate privileges, establish persistence, move between systems, or access any account, device, network, service, or data beyond your authorization
  • Obtain, guess, harvest, expose, alter, destroy, or exfiltrate credentials, authentication tokens, confidential information, personal data, or other protected data without authorization
  • Create, adapt, deploy, operate, or distribute malicious code or infrastructure, including malware, ransomware, spyware, destructive software, botnets, credential phishing, or credential-harvesting systems
  • Impersonate a person or organization to steal information, induce unsafe actions, commit fraud, or gain unauthorized access
  • Damage, disrupt, degrade, overload, or deny access to a system or service; disable security, monitoring, logging, or recovery controls; or conceal unauthorized activity
  • Use AI agents, browser automation, MCP servers, scripts, or coordinated requests to scale or automate conduct prohibited by these Terms

Even when you have authorization, you must not intentionally cause harm to people, property, systems, public safety, or the confidentiality, integrity, or availability of data. You are responsible for reviewing generated code and proposed tool actions before using them and for the consequences of any action you direct, approve, or allow the Services to perform.

You agree not to use the Services to:

  • Generate or disseminate illegal, harmful, or malicious content.
  • Infringe upon the intellectual property rights of others.
  • Reverse engineer, decompile, or otherwise attempt to discover the source code of the Services.
  • Engage in conduct prohibited by the Website Access and Automated Actions or Cybersecurity and Harmful Automation sections above.
  • Engage in any activity that is fraudulent, false, or misleading.
  • Violate the terms of service of any third-party provider or service.
  • Seek, request, or rely on individualized legal, medical, psychological, tax, accounting, financial, or other licensed-professional advice from AI content as a substitute for a qualified professional.
  • Use AI content generated through the Services to provide, market, or represent unlicensed professional services to others.

Support

We offer best-effort support via email and other channels we may make available. Support availability and response times may change over time.

Confidential Information

If either party shares non-public information identified as confidential, the receiving party will use it only to operate or improve the Services, protect it with reasonable safeguards, limit access to those with a need to know under similar obligations, and delete or return it upon request or when no longer needed. These obligations do not apply to information that is public, already known without duty, independently developed, or rightfully received from another source.

Relationship of the Parties

The parties are independent contractors. These Terms do not create a partnership, joint venture, agency, or employment relationship.

Termination

We may suspend or terminate your access to the Services at any time, for any reason, without prior notice, including for a breach of these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will remain in effect.

Service Changes and Availability

We may add, change, or remove features; change default settings, configurations, workflows, interfaces, or other app behavior; impose or adjust usage limits; or discontinue the Services or any part of them at any time. A Service may behave differently from an earlier version or have different defaults after an update. Unless applicable law requires otherwise, we do not guarantee that any feature, default, compatibility, or behavior will remain available or unchanged.

To support legal compliance and user safety, we may at our discretion apply jurisdiction-based restrictions (including geofencing), limit or deny high-risk prompts or workflows, and suspend or disable features in specific locations or contexts. We are not obligated to monitor every interaction and may enforce these controls with or without notice.

Governing Law and Disputes

Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the State of Nevada, without regard to its conflict of law provisions, except to the extent non-waivable law applies.

Informal Resolution First

Before either party starts arbitration, that party must send written notice of the dispute and requested relief to the other party and attempt to resolve the matter informally for at least 30 days. You can send notice to us at tabla.kicker.2g@icloud.com. We will send notice to you using any contact information you have provided to us. If the dispute is not resolved after the 30-day period, either party may proceed as allowed under these Terms.

Small Claims Option

Either party may bring an individual dispute in small claims court instead of arbitration, so long as the matter remains individual and qualifies for small claims court jurisdiction.

Arbitration Opt-Out (30 Days)

You may opt out of the Mandatory Arbitration and Class Action Waiver section by emailing tabla.kicker.2g@icloud.com within 30 days after you first accept these Terms. Your opt-out email must include your full name, the app name, and a clear statement that you are opting out of arbitration. Opting out of arbitration does not affect the rest of these Terms.

If we make a material change to the arbitration or class action waiver terms in the future, you may opt out of the revised terms within 30 days after the updated Terms become effective. Re-accepting unchanged arbitration terms does not create a new opt-out window.

Mandatory Arbitration and Class Action Waiver

Except for disputes that qualify for small claims court, any dispute arising from these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its rules. Proceedings must be brought on an individual basis only, not as a class, consolidated, or representative action. You and Folding Sky Co. waive any right to a jury trial.

The arbitrator, and not any court or agency, will have exclusive authority to resolve all threshold issues of arbitrability and enforceability, including disputes about the formation, existence, scope, validity, interpretation, applicability, or enforceability of these Terms or this arbitration provision, except to the extent applicable law requires a court to decide a particular issue.

Class or representative proceedings are not allowed in any forum. The arbitrator has no authority to consolidate claims or preside over class, collective, private attorney general, or representative matters. If a dispute is heard in court rather than arbitration, each party knowingly and irrevocably waives a jury trial. Nothing in this section prevents either party from participating in a class-wide settlement of claims.

If a court determines that all or part of the class action waiver in this section is unenforceable for a specific claim or request for relief, then that claim or request for relief must be resolved in court and not in arbitration, and only on an individual (non-class, non-representative) basis to the maximum extent permitted by law.

Judicial Forum if Arbitration Is Unavailable

If arbitration cannot be compelled or is held unavailable for a claim, then to the maximum extent permitted by law, that claim must be brought exclusively in the state courts located in Washoe County, Nevada, or in the United States District Court for the District of Nevada, and each party irrevocably submits to the personal jurisdiction and venue of those courts.

Prevailing Party Fees

In arbitration, the prevailing party may recover reasonable attorneys' fees and costs where permitted by law.

Time Limitation on Claims

To the maximum extent permitted by applicable law, any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the cause of action accrues. Claims filed after this period are permanently barred. This limitation applies regardless of the form of action, whether in arbitration or court.

General Terms

Changes to These Terms

We may modify these Terms from time to time. Non-material updates may become effective when posted. Material updates will be reflected in the Last updated date and, where reasonable, by additional notice using one or more of the methods described in the Communications section.

To the extent permitted by applicable law, if you receive reasonably conspicuous notice of updated Terms and continue to access or use the affected Service after the update takes effect, you agree to the revised Terms.

If we make a material change to the Governing Law and Disputes section, we may require additional assent for the updated terms, such as an in-app acknowledgment or click-through acceptance, before continued use of the affected Service. If we request such assent, the revised dispute terms will become effective only when you provide it, except to the extent applicable law permits another method of acceptance.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Folding Sky Co. regarding the Services.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be interpreted to the maximum extent enforceable under applicable law, and the remaining provisions will remain in full force and effect.

If any portion of the Governing Law and Disputes section is held invalid or unenforceable, that portion will be severed and the remainder of that section will be enforced to the maximum extent permitted by law, unless applicable law requires otherwise.

Non-Waivable Rights

Nothing in these Terms limits or excludes any rights, remedies, or protections that cannot be waived or limited under applicable law.

No Waiver

Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment

You may not assign these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time.

Sanctions and Export Compliance

You represent that you are not on any U.S. government sanctions or denied-party lists and that you will not use the Services in violation of export, re-export, or sanctions laws. The Services may be subject to U.S. and other export control laws; you agree to comply with them.

No Third-Party Beneficiaries

Except as expressly provided in the Apple App Store Terms section below, these Terms do not create any third-party beneficiary rights.

Apple App Store Terms

If you obtained any of our Apps through the Apple App Store or Mac App Store, or use any Apple services in connection with our Apps (including in-app purchases, subscriptions, or iCloud), the following terms apply. These terms are required by Apple and supplement the rest of this agreement.

Your use of Apps obtained through the App Store is also subject to Apple's Licensed Application End User License Agreement (opens in new tab) (apple.com/legal/internet-services/itunes/dev/stdeula/) and the Apple Media Services Terms and Conditions (opens in new tab) (apple.com/legal/internet-services/itunes/us/terms.html), which include the Usage Rules governing App Store purchases.

1. Acknowledgement

You acknowledge that this agreement is between you and Folding Sky Co. only, and not with Apple. Folding Sky Co., not Apple, is solely responsible for the Licensed Application and its content.

2. Scope of License

The license granted to you is a non-transferable license to use the Licensed Application on any Apple-branded device(s) that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Maintenance and Support

Folding Sky Co. is solely responsible for providing maintenance and support services for the Licensed Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Warranty

Folding Sky Co. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Folding Sky Co.'s sole responsibility.

5. Product Claims

You acknowledge that Folding Sky Co., not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Folding Sky Co., not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this agreement, and that, upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.

Disclaimer of Warranties

The Services are provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Without limiting the foregoing, Folding Sky makes no warranty or representation regarding the accuracy, completeness, reliability, safety, or fitness of any AI-generated content or output obtained through the Services. AI Content is provided by third-party providers or local models and may be incorrect, incomplete, biased, harmful, or inappropriate. You assume all risk associated with your use of and reliance on AI Content. AI Content is not professional advice and must not be used as a substitute for consultation with a qualified professional in any licensed field, including but not limited to law, medicine, psychology, tax, accounting, or finance. See also the Artificial Intelligence Disclosure section above.

Assumption of Risk

You expressly acknowledge and agree that your use of AI Content obtained through the Services is at your sole risk. You are solely responsible for evaluating the accuracy, completeness, and usefulness of any AI Content before acting on it. Folding Sky does not endorse, validate, or verify AI Content and is not liable for any decision, action, or outcome based on AI Content. Any rankings, comparisons, scores, judgments, summaries, or other evaluations shown in the Services are generated outputs for convenience only and do not constitute professional validation, factual certification, or a recommendation that any output is safe, accurate, or suitable for your specific situation. The Artificial Intelligence Disclosure section provides additional context about how AI content is generated across our Services.

Limitation of Liability

To the maximum extent permitted by law, Folding Sky Co. will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or loss of profits, data, or goodwill. Our total liability for any claim is limited to the greater of the amount you paid for the applicable Service in the 12 months before the event giving rise to the claim or $100.

Indemnification

You agree to indemnify and hold harmless Folding Sky Co. and its affiliates, officers, and employees from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Services; (b) your content; (c) your violation of these Terms or applicable law; (d) your reliance on AI Content as a substitute for qualified professional advice, including but not limited to legal, medical, psychological, tax, accounting, or financial advice; or (e) your use of AI Content to provide, market, or represent professional services to others.

Force Majeure

Neither party is liable for delays or failure to perform due to events beyond its reasonable control (for example, natural disasters, acts of government, outages, or network failures). Performance will resume when the event ends.
